TERMS AND CONDITIONS

Booking
  • You may check availabilities and make a booking enquiry through our website or by emailing our reservations team. Once your booking dates have been confirmed, you’ll receive a booking confirmation email and you’ll be asked to complete your guest information which is to be sent back to our team. All guests who are aged 18 and over must complete this information themselves. All guests under the age of 18 must have a parent or guardian complete this information.
  • By making a booking, you agree to and accept our terms and conditions, including the terms and conditions set out in this document. If you are booking on behalf of another person, we rely on the authority of the person making the booking to act on behalf of any other traveler on the booking and that person will bind all such travellers to these terms and conditions.
  • If you are not ready to make a booking but would like to hold a space whilst you finalise your plans, we can arrange that as well. Please discuss this with our team.
Pricing
  • The prices quoted on our website are the most current prices and are subject to minimum numbers and seasonal demand. The prices quoted cover the following:
    • Pick up and return from the collection and return point designated by the company.
    • Transfers to the start of the relevant walk including ferry transfers
    • Twin share accommodation
    • Food and drinks (alcohol not included)
    • Qualified staff for the duration of the walk
    • Use of company gear for the duration of the walk.
    • Any additional costs are to be borne by the guest.
  • No price reduction is available for guests who elect to bring their own food or alcohol or choose not to avail themselves of the food or drink provided.
  • Without limitation; the following items are excluded from the prices; travel insurance, pre and post walk travel arrangements including accomodation and transport to the collection point and from the return point designated by the company, any expenses not defined as an inclusion in the pricing including tips, personal clothing, medical expenses, items of a personal nature and emergency evacuations.

Accommodation

  • Our advertised prices are based on two people sharing a room in the hotel accommodation. This type of accommodation is typically twin share.
  • Solo travellers are always welcome and if a single room is requested, a single supplement will apply. Requests for single single occupancy must be made at the time of booking.
  • A solo traveler may request a shared room at the time of booking. If a shared room booking request can be arranged, the walker will be advised at the time of booking.
  • If a shared room booking request cannot be fulfilled and a walker wishes to continue booking, a single supplement will apply. Single supplements will be advised at the time the booking is requested.
  • Any damages to hotel rooms are at the guests own costs.

Public holiday surcharge

  • If your departure falls on a public holiday an increased walker rate will be automatically applied to your departure to cover the increased cost of operation.

Payment

  • All pricing is in Australian dollars.
  • A 50% deposit is due at the time of booking.
  • Final payment is due 60 days prior to departure.
  • Bookings made within 60 days of departure must be paid in full at the time of booking
  • Payment may be made through your bank by electronic funds transfer, or online using Google Pay, Apple Pay, PayPal, Amex, Visa, MasterCard or BPay. We do not accept payment by cheque.
  • Once you have secured your booking, any subsequent discounts or price reductions that are advertised by the company will not be applied.
Cancellation and refund policy
  • If you wish to cancel your booking, you must notify the company in writing as soon as possible. Once the company receives your notice, cancellation will take effect subject to the following:
    • The date of cancellation is the date that the company receives written notice of the cancellation.
    • If the cancellation is made 90 days from the scheduled departure date a fee of $400 per person will be charged with the balance payment refunded to you.
    • If the cancellation is made between 90 and 60 days prior to departure, your deposit will no longer be refundable.
    • If the cancellation is made within 60 days of departure, no refund is available.
  • Cancellation by the guest will also take effect if you fail to arrive at the pre arranged meeting place at the time stipulated by the company or your payment of the balance of the booking is not received by the company by the due date.
  • No refund will be paid if you voluntarily leave your walk after it has commenced, including for reasons of bereavement, injury or illness or directed by the company to leave or not commence your walk in accordance with these terms and conditions.
  • The company reserves the right to not provide a refund if you arrive on the day of departure with inappropriate footwear or are unable to join the walk
  • If you wish to change your booking you must notify the company in writing as soon as possible. Once the company receives your notice, the change will take effect subject to the following:
    • One amendment can be made to your original booking, up to 90 days prior to the date of departure at no cost.
    • For booking change made between 60 and 90 days prior to departure there is a $400 per person charge to change the departure date.
    • We cannot accept change to bookings within 60 days of departure.
  • If a scheduled walk does not meet minimum numbers, the company reserves the right to cancel the departure. If we need to cancel a walk for any reason we will provide you with the following options:
    • We can hold a credit towards an alternative booking departure date to be used within 12 months.
    • Provide a replacement walk at a later date convenient to both parties and within 12 months.
  • In the event that your walk is cancelled by the company, we will not be liable for any costs associated with travel to and from the designated walk departure point. We therefore strongly recommend travel insurance be taken out at the time of booking.
Evacuations
  • In rare circumstances, due to injury or illness we may need to evacuate a guest from the trip. Where an evacuation is deemed necessary by the company, the full cost of evacuation will be borne by the guest, including but not limited to ambulance costs and any associated staff wages.
  • For Australian residents, under the Australian government medicare act, it is prohibited for any domestic travel insurance product to provide any financial reimbursement with regards to ambulance services. We therefore strongly recommend guests to take out specific ambulance cover with their health insurance and travel insurance providers.
Travel Insurance
  • When selecting a travel insurance product, please ensure that it provides insurance on personal accidents or injury, medical expenses, force majeure events, personal liability, cancellation for any reason including delayed flights and lost luggage .
Indemnity
  • Harbour Trax tours are conducted on routes that include public pathways and roads, waterways, beaches and parks. Harbour Trax will use its best endeavours to advise of any risks encountered along its scheduled routes, however in accepting these terms and conditions, guests understand and acknowledge the inherent risks associated with walking tours.
  • You hereby agree to indemnify and at all times hereafter keep indemnified and hold harmless the company and its employees, guides, agents or any of them from and against all costs, claims, actions, demands and liability whatsoever and howsoever arising from or in any way connected with the walk and your participation in the walk including such costs, claims, actions, demands or statutory duty or otherwise on the part of the indemnified persons and including any liability in respect of or related to death, personal injury, or less of or damage to any property owned or possessed by us, but excluding any liability which cannot be excluded by applicable laws. the company hold the benefit of any rights accruing to the indemnified persons under this paragraph on trust for the indemnified persons, and you acknowledge and agree that the company can enforce such rights in its own name or in the name of the indemnified persons as their trustee.
Footwear
  • Guests are required to wear supportive walking shoes or hiking boots with firm treaded soles. New shoes should be worn in prior to the commencement of the walk. Waterproof or water resistant boots are recommended
  • These recommendations are made in the interests of your safety and giving you the best chance to have the most enjoyable experience possible. Arriving on the day of departure with inappropriate footwear may result in forfeiting your walk without refund. If you are unsure whether your footwear is suitable for your intended walk, please contact our team for further assistance.
Health and fitness requirements
  • It is your responsibility to read through the itinerary carefully and ensure you have adequate fitness for the proposed trip.
  • Guests must be in good health and have the appropriate physical and mental fitness to maintain a good walking pace for the duration of their walk. Some training and preparation work is required prior to departure. The more physically and mentally prepared you are, the more enjoyable your walk will be. Speak with our team for more information about health and fitness requirements and walk preparation. As an indication, prior to the trip all guests should be able to safely complete a 15 – 20km day walk on varied terrain including bush trails, inclines and street walking. Specific trail distances of the hike can be found in the fitness requirements section on our website.
  • The company reserves the right in its absolute discretion to remove a guest from participation in a trip on medical or fitness grounds.
Medical forms
  • Guests with pre existing medical conditions are required to disclose it on their booking form and may be required to supply a doctors certificate. Guests who are 75 years of age or older must supply a doctors certificate stating that they are in good physical condition and that there are no known ailment or pre-existing medical conditions likely to prevent them from completing the walk.
Dietary requirements
  • Dietary requirements, stating whether it is a lifestyle choice or other, must be noted on the booking form. If dietary requirements are not disclosed to at least 2 weeks prior to your departure date we may not be able cater to your needs.
Guide and Guest responsibilities
  • All our walks are group trips and guests need to be conscious of how their actions may impact others and the environment. All guests and staff must be respectful and mindful of people’s differences. The company guides and staff take their roles and responsibilities seriously and if for any reason the trip leader believes that you should not participate in the trip they may exclude you from the trip, without refund. The trip leader is in charge of ensuring not only your safety but the comfort, safety and enjoyment of the entire group. If for any reason during a trip the trip leader considers you should not participate further due to you committing an illegal act, your behaviour is causing or may cause danger, distress or annoyance to others, or being disrespectful or harmful to the environment, the guide may direct you to not continue on the trip and you must follow their instructions. In this case you will not be entitled to a refund.
Marketing and social media
  • Every so often Harbour Trax will post or publish photos and videos to Harbour Trax social media and other Harbour Trax marketing material. These posts or publications may include images of individuals and groups who are on the hike. Should you wish not to have your images posted or published, you must advise us on or before departure of the tour. Otherwise, you are deemed to have consented to the inclusion of any such material or promotions.
Jurisdiction
  • The laws of the state of NSW in which the walk takes place shall apply to these terms and conditions.
Acknowledgment
  • By placing a booking with the company, guests acknowledge and agree that the company has relied on the representations made by you, including in repeat of your circumstances, travel insurance, availability, age and medical condition which representations you hereby confirm and warrant are true, correct and complete in every respect.
